Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of the FlipFindr website and services (the “Service”), provided by FlipFindr, operated by Riya Platforms, Inc. By accessing our website, joining our waitlist, or opting in to receive messages from us, you agree to these Terms. If you do not agree, please do not use the Service.

Access to the FlipFindr software platform itself is granted under a separate written agreement that you accept in-product before your account is activated. Where that agreement and these Terms conflict with respect to platform use, that agreement controls.

Use of the Service

FlipFindr is currently offered on a waitlist and early access basis. We may add, change, suspend, or discontinue features at any time. You agree to provide accurate information, that you are at least 18 years of age, and that you will use the Service only for lawful business purposes.

SMS Terms & Conditions

By opting in to receive text messages from FlipFindr, you agree to the following terms:

  • You may receive transactional and service messages related to your waitlist signup, product launch, onboarding, and account.
  • Message frequency varies.
  • Message and data rates may apply, depending on your carrier and plan.
  • Consent to receive texts is not a condition of any purchase.
  • You can opt out at any time by texting STOP. After opting out, you will receive one final message confirming your unsubscribe.
  • For help, text HELP or contact flipfindrdev@gmail.com.
  • Carriers are not liable for delayed or undelivered messages.
  • Supported carriers include most major U.S. wireless carriers.
  • We reserve the right to modify or terminate the SMS program at any time.

Data sources & the “as-is” nature of listing data

FlipFindr aggregates public listing data from third-party MLS real estate platforms via data partners. Because that data relies entirely on third-party availability, Riya Platforms does not guarantee the continuous uptime, accuracy, or uninterrupted delivery of the listing data. Access may be modified or restricted without liability if third-party platforms alter their technical barriers.

Messaging compliance & your responsibility

Using FlipFindr to send text messages to real estate professionals involves strict federal and state regulations, including the Telephone Consumer Protection Act (TCPA).

  • Your responsibility: you are solely responsible for the content, timing, and legal compliance of all SMS messages sent through FlipFindr, whether you connect your own SMS system or use an SMS partner network integrated with the platform.
  • Consent & solicitation: you certify that any outreach conducted via FlipFindr aligns with applicable local real estate solicitation laws and telemarketing regulations.
  • Indemnification: you agree to defend, indemnify, and hold harmless Riya Platforms (including its officers, employees, and partners) from any and all claims, fines, penalties, carrier fees, or lawsuits (including TCPA class-action claims) arising from text messages you send using FlipFindr.

Acceptable use

You agree to use FlipFindr only for lawful business purposes and in accordance with these Terms. You shall not:

  • Use FlipFindr in violation of applicable federal, state, or local laws, including telemarketing, privacy, and real estate solicitation laws;
  • Send unlawful, misleading, deceptive, harassing, or unauthorized SMS messages;
  • Upload, transmit, or process information you do not have the legal right to use;
  • Attempt to gain unauthorized access to FlipFindr, its systems, infrastructure, or related networks;
  • Reverse engineer, copy, modify, distribute, resell, sublicense, or create derivative works based on FlipFindr;
  • Circumvent technical limitations, security measures, usage restrictions, or access controls; or
  • Use FlipFindr in a manner that could damage the platform, disrupt service availability, or negatively impact other users or third-party providers.

Riya Platforms reserves the right to investigate suspected misuse and may suspend or terminate your access to FlipFindr immediately if we reasonably believe your use of the Service creates legal, security, operational, or reputational risk. Suspension or termination under this section does not limit any other rights or remedies available to Riya Platforms under these Terms or applicable law.

Intellectual property & feedback

Riya Platforms retains all rights, title, and ownership of FlipFindr, including its software architecture, workflows, proprietary integrations, and system logic. Any suggestions, feature ideas, or bug feedback you provide becomes the sole intellectual property of Riya Platforms, without any obligation of compensation.

Disclaimers & limitation of liability

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, FlipFindr and Riya Platforms will not be liable for any indirect, incidental, consequential, or special damages, including loss of revenue, loss of business opportunities, real estate brokerage disputes, or text-messaging carrier fines. Riya Platforms’ maximum aggregate liability for any reason under these Terms is limited to $100.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware.

Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after any changes indicates your acceptance of the updated Terms.
